ok as some of you know, my son was hit by a minivan a couple of weeks ago, well actually he hit the side of that van, at the time of the accident, there was a large pick up with a full topper on it, that had blocked both veiws, my son couldnt see the van and the van couldnt see my son, well to make a long story short, my son was just banged up a lil and is fine, the van has a nice dent on its front fender from my sons head, eh good thing for him bein hardheaded lol, but, they are insisting that we pay for all the damage, over 1000 for a new fender, now seein as both were at fault here we have offered to pay for half of what it takes to fix the vehicle, the guy is pitching a fit and making accusations of us not being insured, and that we dont watch our son, who is 13, try and keep one of them under thumb constantly, it isnt gonna happen, he has also gone so far as to question my son on if he had been taken to the doctors or hospital, this was done without our permission, we had actually told our son not to speak to the man to let us do that. but my son felt intimidated and answered the guy, not once has the guy showed any real curiousity about our sons well being, only on if there wasmedical bills, he went to a lawyer as did we, then accused us of trying to get out of our responcibilities by goin to one, Now the state i live in usually sides with the child if the case goes in to court, but we are trying to spare our child from thatk ind of thing and offered to pay half atleast, because he was the one who hit the van,

now my question is this:
would you let it go to court and more then likely end up not having to pay, just out of spite because of the way the other party is behaving, or would you go ahead and keep with what you offered, your answers wont ifluence our decision, well not entirely anyway, but i am curious as to what others would do in this situation

I'd do some research and make sure the courts would actually side with me. I wouldn't want to pay half or all of the bill AND court fees. But yeah... I'd probably go to court, muttering all the way there, "Oh, you wanna PLAY, do you?"

sis if it was kadi she would take it to court the man had no right to question your son without your permisson that is where he screwed up, you offered to pay half he refused now take him for damages to you and your son, that is what kadi would do

my method of dealing with the situation would naught be legal nor acceptable by "civilised" society.

however... since he has no business speaking with my son... i would have to remind him of this by brute physical force simply by shoving the guy's head head up his own ass.

then i would have to demonstrate just how lil force is necessary to dent a fender by using his worthless skull as the focal point of the experiment wherein i demonstrate the structural integrity of his van multiple times. first his head meets his own fender multiple times. then show him the difference between the fender and for instance the bumper.... then the hood... then front grill... then the rocker panel when his head becomes slammed repeatedly between rocker panel and door. then after that warm-up session i think i would introduce him to the undercarriage before finishing up by forcing his face into the rotating fan after using his own teeth, or what is left of then to remove the fan shroud.

what he has done to your son without your permission sounds very much against the law. would i allow it to go to court? yuppers.

would the Man actually make it alive to court...

sis i have just reread your post, erm question..........if your son hit the SIDE of the van how did the FRONT fender get damaged ??? ??? ??? ???

-scratches head- He was on a bicycle?  And they are asking if you're insured? -scratches head again- Does your state have bicycle insurance or something? -tilts head- Or are your traffic laws different and pedestrians and CHILDREN ON BICYCLES don't have right of way?  Cause I'm pretty sure that your state is probably the same as mine and that if ANYONE in a moving vehicle who hits someone else outside of an unmotorized vehicle, is at fault, no matter what the consequences, because they are supposed to be in full control of their vehicle AT ALL TIMES. Kinda like if you're following someone..they hit their brakes..you rear end them..you are at fault because you are behind them and have to have full control of your vehicle.  What kind of crappy person blames a child for hitting them to begin with..on a bicycle..the dent can't be THAT big..a kid can only go so fast on a bike. -tosses up hands- People are so shitty nowadays and I would do the same thing as Rags...show him exactly how much damage a hard head can do to a vehicle, and let him thank his lucky stars that your child wasn't seriously hurt...THEN I would sue him for every penny he's worth just for being a raging ASSHAT.  But, that's what I would do in my humble and very honest opinion.

well luckily we had been talked in to getting renters inssurance, because something like this IS covered by it, and, according to them, because Bri had entered the parkinglot without getting off his bike to check for traffic in a crwded parkinglot, he IS at -just keeps remembering all the LITTLE kids that were running around that day and i mean 5 and 6 yrs olds and some smaller, some bigger- fault, but we were advised to cotact a lawyer because of the fucktards accusations, and for contactting our child without our permission, -weg- he WILL be paying and dearly,

kadi, here the front fender is the quarter panel that surround the wheel it goes from the front side of the veihicle to the front door,  where Bri hit was between the door and the wheelwell, go figure, just by a matter of a few inches my son is at fault,

Master i so wish You could come and do all of that, this man has had my son scared to go down to the park where he spends at least 90% of his day,, Master Kan can tell you, its a lifesaver for us that it is so close for him to be able to burn off excess energy. i should have took what his wife had said to my son as a forwarning of what was to come, because she had leanedin through the window to check on B and said "no matter what happens, your more important"  gotta wonder if this is habit for this punk. or if he is this way with his own kids.

Mistress, i guess that pedestrians DONT have the right of way in WIsconsin, its pretty bad when your afraid to let your kid go out on his bike, if he had one anymore. Also the impact was pretty hard, hard enough to knock Brians shoes off his feet when he hit, and also broke the brakes on the handlebars, and twist the front forks on it as well. so now i have a son, with no bike and no way to get him another right now, pretty much makes ya feel like shit because i depend on him to go to the store andbank forme when the other half is gone because i cant walk very far at all, about all i can do is make it out to the drive and that takes about 5 to 10 minutes.

Master Kan all i can say it  - HOLDS UP A PAPER WITH ADDRESS AND PHONE NUMBER-

now i am faced with trying to find the money to replace his bike and to sit and try to get across to him that not all people care about others, this isnt going to be easy because my son is like the world class of social butterlfys,-grins at Master Kan cause He knows first hand about how B is with people-  he will gravitate to anyone who will talk to him and spend time with him, my son has severe ADHD, and is develepmentally slow, this child trusts any and everyone he comes in contact with no matter what i say or do,

ok puttin on my lawyer robe ahem   as to the fault it rests with the driver no matter what.. as it is said a child under the age of majority is not at fault for actions of vehiciles when driven by persons either not payin attention because of outside influences ie cell phone conversations or conversations with a passenger it is IS THE FAULT OF THE DRIVER  not the child to pay attention when in a park zone area or school zone...... but then this is a canadian law so not sure as to the laws in the south... hmmm gonna do some research and edit this if needed...


dam sis i wish iwas there i would nail his sorry ass to the court room wall and no amount of court officials is gonna be able to stop a very angry Auntie duckie....
